Introduction

Welcome to BayBytes! These Terms and Conditions govern the use of our services, including but not limited to website development, digital marketing, branding, and more. By using our services, you agree to comply with and be bound by these terms.

Definitions

  • Client refers to the individual or organization purchasing services from BayBytes.
  • Services include website development, digital marketing, branding, and related offerings provided by BayBytes.
  • Project refers to any work performed by BayBytes for the client.

Scope of Services

BayBytes offers a wide range of digital services, including but not limited to:

  • Website design and development
  • Digital marketing campaigns
  • Branding services

All services will be detailed in the contract provided before starting the project.

Payment Terms

For all website development projects, the payment structure is as follows:

  • Advance Payment: 30% of the total project cost is payable upfront before the project commences.
  • Mid-Project Payment: 50% of the remaining project cost is due once 50% of the work is completed.
  • Final Payment: The remaining balance of the project cost is due upon project completion.

For digital marketing and branding services, specific payment terms will be discussed based on the contract.

Failure to make the agreed payments may result in the suspension of services (refer to Project Termination and Suspension).

Refund Policy

BayBytes does not offer refunds on any services once they have been initiated. If a client wishes to terminate the project midway, no refund of the advance or any completed stages will be provided. Refunds are only applicable in case of a clear contractual breach on the part of BayBytes.

Project Termination and Suspension

In the event a client chooses to stop the project after work has commenced, the following terms will apply:

  • Any work already completed must be paid in full.
  • If the client denies completing the full payment upon project completion, BayBytes reserves the right to hold the project, cease further work, and in the case of website development, take down the website from live servers and search engines.
  • In critical cases, legal action may be taken if payment disputes are unresolved.

Intellectual Property

BayBytes retains all rights to any proprietary methods, software, and code used during the project. Upon full payment, ownership rights for the final deliverables will transfer to the client. However, BayBytes reserves the right to use any completed projects in their portfolio for promotional purposes.

Confidentiality

Both parties agree to maintain confidentiality regarding all business matters discussed and information shared throughout the project. Sensitive client data and proprietary information will not be shared with third parties without explicit consent.

Limitation of Liability

BayBytes will not be held liable for any indirect, incidental, or consequential damages arising from the use of our services. Clients are responsible for ensuring the accuracy of all content provided for the project.

Careers Section

For job applicants applying via the Careers page:

  • Information collected for recruitment purposes (including names, contact details, and qualifications) will be used solely for the hiring process.
  • Applicants consent to having their details stored until the hiring process concludes, after which their information can be deleted upon request.

Legal Actions

In extreme cases, where clients refuse to pay for services rendered after completion, BayBytes reserves the right to initiate legal action to recover the amount due. This includes withholding the final deliverables or disabling any live projects.

Amendments and Updates

BayBytes reserves the right to update these Terms and Conditions at any time. Changes will be communicated to clients via email or website notices.
